Digital Services Act (DSA) Single Point of Contact

SmartHost ensures full compliance with the requirements set out in the Digital Services Act (Regulation (EU) 2022/2065). The DSA establishes a robust regulatory framework to promote transparency and accountability in digital services across the European Union. As part of these requirements, we have designated a single point of contact to facilitate communication on matters related to the DSA.

What is the Digital Services Act (DSA)?

The Digital Services Act (DSA) is a regulation enacted by the European Union to create a safer and more transparent digital environment for all users. The legislation, which became fully applicable on 17 February 2024, aims to combat illegal content online, enhance transparency, and protect users’ fundamental rights. The DSA imposes obligations on digital platforms, online marketplaces, and other intermediary service providers to ensure accountability and mitigate risks associated with their services.

Key objectives of the DSA include:

  • Establishing rules to prevent the dissemination of illegal content, products, and services.
  • Ensuring digital platforms implement transparent systems for handling user complaints and content moderation.
  • Providing greater oversight of very large online platforms (VLOPs) and their impact on society.
  • Strengthening cooperation between national regulators and the European Commission for effective supervision and enforcement.

By setting these standards, the DSA ensures that digital service providers operate in a fair and transparent manner, contributing to a safer online ecosystem for users, businesses, and regulators alike.

SmartHost as an Intermediary Service Provider (ISP)

SmartHost is considered an Intermediary Service Provider (ISP) under the DSA due to the nature of our services. ISPs play a vital role in the digital economy by enabling the storage, transmission, and dissemination of user-generated content or services. SmartHost provides hosting services that facilitate the operation of websites, applications, and other online services, which fall under the scope of the DSA.

As an ISP, SmartHost is subject to specific obligations outlined in the DSA, including:

• Transparency Requirements:
We must provide clear and accessible information about our policies, terms of service, and complaint-handling procedures. This ensures that users and regulators understand how our platform operates.

• Notice and Action Mechanisms:
SmartHost is required to implement mechanisms for users to notify us of illegal content or activities. Upon receiving such notifications, we are obligated to act promptly to assess and address the issue.

• Data Protection and Privacy:
We adhere to stringent data protection standards to safeguard user information and maintain compliance with the General Data Protection Regulation (GDPR).

• Cooperation with Regulatory Authorities:
SmartHost collaborates with regulators and law enforcement agencies to address concerns related to illegal content, consumer protection, and cybersecurity.

• Reporting:
As part of our compliance efforts, we report on content moderation practices and other relevant activities to enhance transparency.
